Operation Military Kids (“we,” “us,” or “our”) respects the intellectual property rights of others and is committed to responding to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
This DMCA Policy applies to the website https://www.operationmilitarykids.org (the “Site”).
1. Designated Copyright Agent

2. DMCA Takedown Notice Requirements
If you believe that material on the Site infringes your copyright, please send a written notification to our Copyright Agent containing the following information (as required by 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the exact URL).
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Our Response to DMCA Notices
Upon receipt of a valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing material. We will also promptly notify the user who posted the material that we have removed or disabled access to it.
We reserve the right to terminate the accounts or access of repeat infringers in appropriate circumstances.
4. Counter-Notification
If you believe that material you posted on the Site was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification with our Copyright Agent containing the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which the Site may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
Upon receipt of a valid counter-notification, we will promptly provide the original complaining party with a copy of the counter-notification and inform them that we will restore the removed material or cease disabling access to it in 10–14 business days unless we receive notice that the complaining party has filed a lawsuit against you.
5. Repeat Infringer Policy
In accordance with the DMCA and our own policies, we will terminate, in appropriate circumstances, the access of users who are determined to be repeat infringers of copyright-protected material.
